GENERAL

The Avion Rewards Program is a marketing program that is offered as a benefit for RBC Bank's credit card clients. The Avion Rewards Program is sponsored by RBC Bank (Georgia), N.A. ("RBC Bank") and is administered by Kobie Marketing Inc., an independent contractor not affiliated with RBC Bank®. 

In these Program Rules, the Avion Rewards Program will be referred to individually as a "Program" and collectively as "Programs" throughout this document. "We", "us", and "our" refer to RBC Bank; "you" and "your" refer to each cardholder who is authorized to use the credit card account.

These Program Rules are separate and distinct from your Cardholder Agreement. The Program is offered at our sole discretion. We reserve the right to change the Program Rules, including the point reward structure or levels, fees, point accrual criteria or redemption criteria at any time without notice. The changes may be prospective and they may be retroactive. When a change is made, we will post a revised version of the Program Rules on the Program web site at rbcbankrewards.com. Changes will be effective on the date noted when they are posted online. It is your responsibility to review the Program Rules from time to time to be aware of any such change(s). It is also your responsibility to ensure we have accurate contact information for you including a valid e-mail address, as the majority of Program information will be communicated via e-mail or posted on the Program web site. We are not responsible for delayed or lost communications sent by U.S. mail or any other form of delivery, including e-mail.

We may also cancel or suspend the program at any time without notice. In addition, RBC Bank reserves the right to approve, deny or revoke membership or the right to participate in the Program with respect to any person for any reason whatsoever, in RBC Bank's sole discretion.

If you are a resident of the state of New York, effective December 10, 2023, as a result of a State of New York law, rewards program participants that are residents of the State of New York will be provided with a notice within 45 days of a modification, cancellation, or termination of the rewards program, or the closing of a participant's credit card account, that will result in forfeiture of credit card rewards program points, informing the participants that they have 90 days to redeem or exchange their rewards points. The 90-day period for redemption or exchange of the rewards points begins on the date of the notice. After the 90-dfay period, the participants' points are forfeited and may no longer be redeemed or exchanged. These rights under New York state law are not applicable if the participant's credit card account or program participation has been closed or terminated as a result of participant fraud or misuse of the account or program. We [The Bank] determine[s] participant residency on the date an account is closed or the program is modified, changed, or cancelled, based on the primary account address on our account records, i.e., we consider a participant a resident of the State of New York if the primary account address on record of the date of the account closure or program modification, change, or cancellation is the State of New York.

Points have no cash or monetary value, are non-negotiable, and cannot be redeemed either in whole or in part for cash or any other remuneration except for rewards and rewards-related services offered through the Program described herein.

Points do not constitute property of any person and may not be brokered, bartered, attached, pledged, gifted, sold, or transferred upon disability, death, upon operation of law, or in connection with any domestic relations dispute and/or other legal proceeding. All points will expire on the expiration date indicated in these Program Rules. Upon closing an account, either voluntarily or involuntarily, all points will be forfeited without any further obligation from RBC Bank. All questions or disputes regarding eligibility for either one or both of the Programs, or the eligibility for the accrual of points or redemptions will be resolved by us in our sole discretion.

You are responsible for any federal, state or local tax liability and reporting related to your participation/membership in the Program including any liability relating to any rewards you redeem under the Program.

The Program is not available and is void where prohibited by federal, state or local law or regulation.

By using your RBC Bank credit card account, you, or any authorized to use the account, accept all of the terms and conditions in these Program Rules and release us and hold us harmless from any claim, liability or damage relating to the Program or use of any reward received.

Fraud or abuse relating to the accrual of points or any redemption may result in forfeiture of accrued points, as well as cancellation of participation/membership in the Program.

Points cannot be earned until an RBC Bank credit card account has been established and a card account number has been assigned to you. No retroactive credit will be given. The Program is restricted to use by individuals assigned a credit card(s) and we reserve the right to approve, deny or revoke participation/membership in the Programs for any reason. Should you close your credit card account or if it is otherwise terminated or closed, you will no longer be able to redeem points and all points will be forfeited. Your account must be in good standing to earn and redeem points under the Program and credit card accounts more than sixty (60) days past due will not earn points. If your credit card account becomes more than ninety (90) days past due, you will forfeit all accumulated points. For any RBC Bank credit card accounts in hold, voluntarily or involuntary closed status, outstanding points may not be transferred to a new or active account and all points will be forfeited.

The information contained in these Program Rules is effective December 10, 2022 for new purchases charged on your RBC Bank personal credit card on or after that date and for all points accrued prior to April 25, 2019 transferred to your Program account. EARNING POINTS - CREDIT CARD ACCOUNTS

With the Avion Rewards Platinum and Signature Black credit cards you will earn one (1) point for each net U.S. dollar you spend on eligible purchases. With the RBC Signature Black Plus card you will earn one and half (1.5) points for each net U.S. dollar you spend for eligible purchases. Cash and cash-like transactions including but not limited to cash advances, ATM withdrawals, convenience checks, unauthorized charges, betting track, casino transactions, lottery tickets, money orders, money travelers' checks from a non-financial institution, foreign currency cash purchases, bail bonds, debit cancellation charges, points purchased and fees of any kind are excluded. Points earned for refused charges will be reversed. Points will be calculated Tuesday through Saturday, except holidays, and will post two business days after receiving transaction data. Points earned on all other days will post within seventy-two (72) hours. Earned points are calculated on actual U.S. dollars spent rounded to the nearest point. No fractional points will be awarded.

POOLING POINTS

Avion Rewards Program clients may "pool," which means combine, the points earned from their personal credit card account(s). Consumers may also pool the points earned from their personal credit card accounts together with any other RBC Bank Avion Rewards or Rewards Plus clients' personal credit card account(s). If you choose to pool your account(s) with other RBC Bank clients' Avion Rewards or Rewards Plus account(s), you acknowledge that you relinquish control over who redeems any points in the pool, including your own.

The Rewards pooling functionality is available on all RBC Bank Avion Rewards or Rewards Plus cards and there is no limit to the number of accounts that can be pooled and no existing relationship constraints (same last name, street number, etc.) are required to pool accounts. All requests for pooling, even for the clients pooling their own credit card accounts, must be completed online through the Program web site at rbcbankrewards.com. You must send an electronic invitation to all RBC Bank Avion Rewards and Rewards Plus clients that you would like to join a Rewards pool (including yourself in order to pool your credit card accounts). All clients must accept your invitation before accounts are pooled. All clients must acknowledge the Program Rules for pooling points, and fully understand that there is an inherent risk for clients when choosing to pool all of the points they have earned individually with others in the pool.

All points accrued, redeemed and expired will be determined based on a first-in, first-out (FIFO) accounting convention. All points are time-stamped according to when they are earned by the aggregate members of the pool. When redeeming, the oldest points in the aggregate pool (first-in) are the first to be redeemed (first-out) regardless of the individual client that has requested the actual redemption, or earned the original points.

Additionally, members of the pool cannot control specifically who other members of their pool choose to invite to join the pool. All members of an existing pool will be alerted by e-mail (for those members of the pool that have registered a valid e-mail address) when a member of the pool invites a new member to join the pool. The initiating member of the pool can discontinue participating in the pool at any time but cannot decide who can join the pool. All accepted invitations must be validated for security purposes against the User Name and password for clients that have registered on the Program web site. Actual account information will be validated for clients not previously registered on the Program web site.

All clients participating in the pool will have access to view detailed information on their own personal Reward(s) accounts. Pooled members can only see their own personal detailed transaction history attached to their account, and will have access to view available pooled points in aggregate. All members in the pool may redeem any points available within the pool, regardless of which account earned the points originally. Points are redeemed based on first-in, first-out (FIFO) principles, regardless of who earned the points or who redeemed the points.

LEAVING THE POOL

Rewards clients that choose to leave a pool must request to be "unlinked" via the Program web site. Any member of the Rewards pool can leave the pool at any time and without notice. Upon voluntary or involuntary closing of an account, the client will not receive a reminder to redeem points earned. Once the account is closed, all points for that member of the pool are surrendered and deducted from the pool. If not closing an account, but unlinking from the pool, the point balance from the departing client will be retained by that client, and deducted from the pool. For example, if three clients pool their credit card account(s) and one client decides to leave the pool and keep their individual account(s) segregated, the account(s) is unlinked and the individual's earned points that have not yet been redeemed are retained on that client's Avion Rewards account. Each individual account can only participate in one pool at any time. If a client is already in a pool with one card, they must unlink their current pooled account to join another pool. There is no loss or forfeiture of points in this scenario.

TRANSFERRING POINTS WITHIN THE RBC BANK AVION REWARDS PROGRAM

You may transfer some or all of the points in your Avion Rewards account to a second Avion Rewards account in your name or transfer some or all of the points in your Avion Rewards account/pool to another Avion Rewards account at RBC Bank. All point transfers must be completed online through the Program web site at rbcbankrewards.com.

Your transfers are remitted immediately when processed. You must be registered with an online Avion Rewards profile and password to complete a transfer to another Avion Rewards account and accept the terms associated with this transfer. Only the primary and co-borrower cardholders with the authority to redeem on the Avion Rewards account may transfer points. You will be able to transfer your credit card points on the Program web site using the Transfer Points feature. The account/pool being debited for the points being transferred as well as the account receiving the transferred points must be with RBC Bank and must be open and in good standing. You may not transfer points to a closed account or to an account outside the RBC Bank Avion Rewards Program.

To complete a transfer, select the "Transfer Points" tab and choose the option to transfer to another RBC Bank Avion Rewards account. Provide the required information to complete the transfer. You must provide the full name and 16-digit card number of the recipient account to complete this redemption request. Follow the online steps to complete the recipient's name, Avion Rewards card number and the point value of the Transfer. You may transfer some or all of the points in your Avion Rewards account/pool to another Avion Rewards account at RBC Bank. The transfer may be to your own account or the account of another Avion Rewards member at RBC Bank. You must be registered on rbcbankrewards.com and will need to log in to your account on the site to view your points balance and conduct the transfer. Points cannot be transferred using the Rewards Customer Service Call Center. However, you may contact our agents for assistance in completing the point transfer online.

Transferred points will be determined based on a first-in, first-out (FIFO) accounting convention. All points are time-stamped according to when they are earned. When transferring, the oldest points (first-in) are the first to be transferred (first-out). All transferred points will retain their original expiration date.

TRANSFERRING POINTS FROM RBC BANK to RBC ROYAL BANK OF CANADA AVION REWARDS PROGRAM

You may transfer points in your U.S. Avion Rewards account with RBC Bank to your Canadian Avion Rewards account with RBC Royal Bank of Canada. All point transfers must be completed online through the Program web site at rbcbankrewards.com. 

When transferring points, points are converted at a 1 to 1 ratio from RBC Bank to RBC Royal Bank of Canada - meaning for every 1 RBC Bank Avion point transferred, you will receive 1 RBC Royal Bank of Canada Avion Rewards point.

Transferred points are debited from your RBC Bank Avion Rewards accounts immediately when processed. The points will be credited to your RBC Royal Bank of Canada Avion Rewards account within 7 business days of submission of the transfer request.

You must be registered with an online RBC Bank Avion Reward profile and password to complete a transfer to your RBC Royal Bank of Canada Avion Rewards account and accept the terms associated with this transfer. Only the primary and co-borrower cardholder with the authority to redeem on the Avion Rewards account may transfer points. You will be able to transfer your credit card points on the Program web site using the Transfer Points feature. The RBC Bank account from which the points are being transferred must be open and in good standing and points may not be transferred to a closed account or an account outside the RBC Royal Bank of Canada Avion Rewards Program.

To complete a transfer, select the "Transfer Points" tab and choose the option to transfer to an RBC Royal Bank of Canada Avion Rewards account. To complete the transfer request, you must provide the full name and 16-digit card number of your recipient RBC Avion Rewards account at RBC Royal Bank of Canada, as well as the point value of the transfer. You may transfer points in increments of 1,500 points to a maximum of 250,000 points per transaction. There is no limit to the number of transfers you can make, as long as the points are available in your Avion Rewards account/pool. The transfer must be to your own RBC Avion Rewards member account at RBC Royal Bank of Canada. You must be registered on rbcbankrewards.com and will need to log in to your account on the site to view your earned points and conduct the transfer. Points cannot be transferred using the Rewards Customer Service Call Center. However, you may contact our agents for assistance in completing the point transfer online. Transferred points will be determined based on a first-in, first-out (FIFO) accounting convention. All points are time-stamped according to when they are earned. When transferring, the oldest points (first-in) are the first to be transferred (first-out). All transferred points will be guided by the Terms and Conditions of the RBC Avion Rewards Program at RBC Royal Bank of Canada.

AUTO-TRANSFERRING POINTS FROM RBC BANK to RBC ROYAL BANK OF CANADA AVION REWARDS PROGRAM

To have your points automatically transferred to the RBC Royal Bank of Canada Avion Rewards account, you may enroll in the Avion Rewards auto-transfer feature. This option is offered in the Avion Rewards registration process, and may also be found on the Transfer Points page.

To enroll in auto-transfer select the ''Transfer Points" tab and choose the option to "Transfer to Canadian Account". To enroll in the auto-transfer feature you must complete a transfer request by providing the full name and 16-digit card number of your recipient RBC Avion Rewards account at RBC Royal Bank of Canada, as well as the point value of the transfer. Prior to selecting continue check the "Auto-transfer Points to your Canadian Avion Rewards account" box. You may manually transfer points in increments of 1,500 points to a maximum of 250,000 points per transaction, however the auto enroll feature will automatically transfer your points to the RBC Royal Bank of Canada Avion Rewards account once you accumulate 1,500 points.

Auto-transferred points are debited from your RBC Bank Avion Rewards accounts immediately when processed. The points will be credited to your RBC Royal Bank of Canada Avion Rewards account within 7 business days of submission of the transfer request.

Auto-transferring points are converted at a 1 to 1 ratio from RBC Bank to RBC Royal Bank of Canada - meaning for every 1 Avion point transferred, you will receive 1 RBC Royal Bank of Canada Avion Rewards point.

If you are enrolled in auto-transfer and the recipient RBC Avion Rewards account at RBC Royal Bank of Canada account changes, you will need to go through the steps above to re-enroll into the auto-transfer feature.

To de-enroll in the auto-transfer feature, select the ''Edit Profile'' tab and select the box labeled ''I'd like to stop auto-transferring points to my Canadian account''.

Once points are transferred, the transfer will not be reversed and points will be guided by the Terms and Conditions of the RBC Avion Rewards Program at RBC Royal Bank of Canada.

PURCHASING POINTS

Avion Rewards clients may purchase additional points to be allocated to their Rewards account. Points are sold in 1,000 point increments at a cost of $35.00 U.S. per 1,000 points, or 3.5 cents per point. Each individual account within/outside a pool is limited to purchasing 5,000 points in a calendar month and 25,000 points annually Points can be purchased online through the Program web site at rbcbankrewards.com or by calling an RBC Bank Client Service Representative at 1-877-521-2035. All points must be purchased using your RBC Bank credit card. All purchased points will be posted and available immediately, and the transaction will be authorized within one business day. Once purchased, the transaction is considered final and points cannot be refunded or exchanged. All of the Program Rules apply to points that are purchased.

POINTS EXPIRATION

Points have a maximum three (3) year term, and expire at the end of three (3) years, based on first-in, first-out (FIFO) principles. Base and bonus points will have the same three (3) year expiration term. Points expiring during the year will be cleared from your account on the last day of the month in which the points expire. For example, points earned on November 5, 2022 will expire on November 30, 2025.

All points earned prior to February 17, 2012 will also retain their original three (3) year expiration date.

REWARD REDEMPTION

Program members may redeem points for gift cards; cash-back credits; free and discounted travel options including airline tickets, hotel, car rentals, cruises and tours; merchandise and other rewards, as explained in detail on the Program web site at (rbcbankrewards.com) or by contacting an RBC Bank Client Service Representative at 1-877-521-2035. Redemptions are provided and serviced by the Avion Rewards Redemption Center; hours of operations for telephone redemptions are 8:00 am to 9:00 pm Eastern Time (ET), Monday through Friday, and 8:00 am to 8:00 pm Eastern Time (ET), Saturday and Sunday. All redemptions under the Program including, but not limited to, the redemption for gift cards, airline tickets or other travel options, or merchandise must be ordered through our Redemption Center by telephone or via the Program web site. When using the web site redemption option, you must first create an account User I.D. and password for access to the web site. There are no exceptions. It is critical to understand that if participating in a Rewards pool, points may be redeemed by any member or Program Manager of the pool without further authorization or notification. It does not matter who earns the points when redeeming in the pool, so by accepting the Terms & Conditions/Program Rules for Avion Rewards you agree to relinquish any control over who in your pool redeems points from the aggregate pool.

Customers with an RBC Signature Black Plus card may have access to some additional gift cards, merchandise items and other redemption options that may not be available for customers with a RBC Platinum or RBC Signature Black card. As a result, it is critical to understand that when redeeming points from a pool, the redemption options available are based on the product completing the redemption. In other words, customers redeeming from a pool using an RBC Signature Black Plus card product may redeem from any of the RBC Signature Black Plus card redemption options available; including Cash-back credits at a face-value of 1.25% even if the points being redeemed from the pool were earned by a RBC Platinum or RBC Signature cardholder. Customers redeeming from a pool using a RBC Platinum card product may redeem from any of the Platinum redemption options available; including Cash-back credits at a face-value of 1.00% even if the points being redeemed in the pool were earned by a RBC Signature Black Plus cardholder. Customers redeeming from a pool using an RBC Signature Black card product may redeem from any of the RBC Signature Black card redemption options available; including Cash-back credits at a face-value of 1.00% even if the points being redeemed in the pool were earned by a RBC Signature Black Plus cardholder.

All additional costs, including but not limited to, travel redemption fees, or expediting shipping are the responsibility of the client and must be charged on an RBC Bank credit card or against available points within the Program. In some instances, clients will have an opportunity to redeem points for these additional costs.

When we receive your redemption request, we will review your RBC Bank credit card account to verify that your point earnings are valid and that you have sufficient points to receive the reward you are requesting. If a credit or other adjustment results in insufficient points for a reward, we will not fulfill the reward. Points are deducted from your account in real-time. If the reward is fulfilled and a subsequent adjustment is made or we later discover that you did not have sufficient points for that reward, you will forfeit future point earnings until you accrue sufficient points. You also agree that you owe RBC Bank the value of the redemption in the event you did not have sufficient points to redeem. Once redeemed, rewards are non-refundable and cannot be exchanged. In the event an airline flight, cruise or tour is involuntarily cancelled, Avion Rewards will reinstate points for the unused portion of the travel reward to your account.

Rewards will only be shipped to the client's address on file and we are not able to send rewards to a P.O. Box. If you do not receive your reward within the indicated time frames, you must contact us within ninety (90) days from the date of your request for the reward. After ninety (90) days, if we have not heard from you and our records indicate that your reward was fulfilled, you will be deemed to have received your reward and it will not be replaced even if it is reported missing. RBC Bank is not responsible for delayed or lost communications or redemptions sent by U.S. mail or any other form of delivery, including e-mail. From time to time, some rewards may be subject to certain restrictions or delays due to such factors as time constraints, blackout dates or availability of qualifying merchandise.

TRAVEL REWARD TERMS & CONDITIONS

Avion Rewards clients have three distinct options for redeeming points for free or discounted travel rewards, including air, car, hotel, cruises and tour packages.

(1) My Way Rewards Statement Credit - You may book any flight, car rental, hotel night, tour package or cruise through any certified Travel Agency, including online Travel Agencies such as, but not limited to: Travelocity, Expedia, cxLoyalty, Orbitz, Hotwire, or Priceline.com. You may also use any traditional Travel Agency of your choosing. You simply purchase any available flight, hotel stay, car rental, cruise or tour package of your choosing. Once the credit card transaction posts to your RBC Bank credit card (normally within 72 hours), you must contact an RBC Bank Client Service Representative at 1-877-521-2035, or go to the Program web site at rbcbankrewards.com to request a Statement Credit for the transaction in full or in part. Each My Way Rewards Statement Credit redemption request must correspond to a single travel transaction. If you request a Statement Credit for part of the transaction cost, the unredeemed charge will remain on your RBC Bank credit card. The amount of points deducted and the corresponding Statement Credit cannot exceed the available point balance in your account.

(2) Full Service Travel Anywhere Reward - Clients may redeem points in a one-step process for travel rewards through our full service travel partner, cxLoyalty. Tickets may be booked through the Program web site. rbcbankrewards.com The number of points required to redeem for a reward is based on the actual cost of the trip booked. All commissions and transaction fees are included in the cost of the trip. Airline tickets may be ordered through cxLoyalty for one roundtrip ticket on a scheduled carrier. No one-way, open jaw (ticket purchased where the traveler returns to the airline from a city other than the one in which he arrived or the final destination is not the same as the original departure city), open return (ticket purchased for round-trip travel without a specified return time and date), standby, stopover or circle trips are allowed. This ticket may not be combined with certain special or promotional fare offer or any other discount, coupon, Senior Citizen discount, off-tariff, non-published or other privately negotiated discount fares, group or block discounts, meeting fares, military or other government fares.

· Additionally, clients can also redeem points for a $100 or $300 "travel discount" which can be applied against any flight of your choice without restrictions or limitations.

· Travel reservations and ticketing must be completed twenty-one (21) days prior to actual departure date, but not more than 330 days in advance.

· All travel rewards are subject to specific terms and conditions. Unless otherwise noted, airline reservations must originate from the contiguous 48 States. The terms and conditions of any travel offer may be amended by the Program at any time. Tickets-issued travel rewards must be issued in the name of the redeeming clients or a member of their immediate family. RBC Bank is not responsible for the performance of the travel provider's associates with the Program. All reservations are made subject to the conditions of carriage, supply or business of the party providing the service, which include exclusions and limitations of liability.

· Travel must be via the most direct, valid routing and in markets for which airlines publish adult excursion fares. In some instances, code shares (flights marketed by one airline, but operated by another airline) may not be allowed.

· For international destinations, travel is only valid to major international gateway cities that are supported by participating carriers.

· All airline ticket rewards issued in exchange for Program points are non-refundable after ticket issuance.

· Change, exchange or refunds are subject to airline rules in effect at the time of original ticket issuance and pricing in effect at the time changes are made. Some previously purchased tickets can be exchanged subject to a per-ticket airline change fee plus any difference in fare. Some previously purchased tickets may not be reissued once travel has commenced. Any changes will incur a $25.00 fee payable at the time the change is made.

· Lost, stolen or otherwise destroyed airline ticket rewards will not be replaced.

· Additional tickets purchased through the contracted program travel agency will incur a $25.00 per ticket processing fee.

· Once redeemed, points for voluntarily cancelled or refunded tickets may not be reinstated to your account. Once tickets are purchased, they are non-transferable.

· Accrual of frequent flyer mileage and airline mileage upgrade is subject to airline terms and conditions at the time of ticket issuance.

· All tickets will be issued electronically when available. Issuance of a paper ticket is subject to airline rules and fees. A delivery charge will apply to all tickets or documents sent via "express" or "traceable" type mail. RBC Bank does not recommend using regular U.S. Mail and maintains no responsibility for lost or stolen tickets or documents.

· Non-ticketable taxes, such as airport departure taxes specific to certain destinations, that cannot be calculated nor paid in advance nor assessed at the time of ticketing are the responsibility of the traveler and must be paid at the airport.

· No tickets will be issued for destinations under travel embargo by the U.S. government.

· RBC Bank reserves the right to pass on any special, unique or ad-hoc airline imposed taxes, fees or surcharges. RBC Bank may, at its discretion, change the Program or redemption rules at any time, with or without notice. Any rewards may be withdrawn or subject to increased points or other cash surcharges or other restrictions.

GENERAL RULES & CONDITIONS FOR TRAVEL REWARDS REGARDLESS OF BOOKING CHANNEL

· Change, exchange or refunds are subject to airline rules in effect at the time of original ticket issuance and pricing in effect at the time changes are made.

· Lost, stolen or otherwise destroyed airline ticket rewards will not be replaced.

· Once redeemed, points for voluntarily cancelled or refunded tickets may not be reinstated to your account.

· Once tickets are purchased, they are non-transferable.

· Accrual of frequent flyer mileage and airline mileage upgrade is subject to airline terms and conditions at the time of ticket issuance.

· Certain restrictions may apply to tickets and documents. Tickets and documents are not exchangeable, refundable, transferable or redeemable for cash.

· All tickets will be issued electronically when available. Issuance of a paper ticket is subject to airline rules and fees. A delivery charge will apply to all tickets or documents sent via "express" or "traceable" type mail. RBC Bank does not recommend using regular U.S. Mail and maintains no responsibility for lost or stolen tickets or documents. The client is responsible for any applicable fees and taxes associated with travel redemptions.

· All travel rewards are subject to the rules and restrictions imposed by the individual travel companies, airlines, hotels, rental car, and cruise line and tour companies. Compliance with these rules is the responsibility of the client. Airline ticket travel rewards are not refundable nor may they be returned to the Program for a credit of points to the original account. They are non-changeable unless permitted by the airline issuing the ticket. Fees that apply due to permitted changes by the airline are the responsibility of the traveler. En-route stopovers are not permitted unless they are to make direct connections within the carrier's rules. Air travel must be all on the same airline.

· Non-ticketable taxes, such as airport departure taxes specific to certain destinations, that cannot be calculated nor paid in advance nor assessed at the time of ticketing are the responsibility of the traveler and must be paid at the airport.

· No tickets will be issued for destinations under travel embargo by the US government.

· RBC Bank reserves the right to pass on any special, unique or ad-hoc airline-imposed taxes, fees or surcharges. RBC Bank may, at its discretion, change the Program or redemption rules at any time, with or without notice. Rewards may be withdrawn or subject to increased points or other cash surcharges or other restrictions.

TRAVEL DOCUMENTATION

· Upon receipt of travel documents or confirming itinerary, please verify the travel dates, origination and destination cities and travelers' names to ensure they are the same as shown on the valid proof of identification that will be displayed at the time of check-in.

· For domestic travel, it is your responsibility to obtain and have possession of government-issued photo identification for all travelers 16 years of age or older.

· For international travel, it is your responsibility to obtain and have possession of valid proof of citizenship or naturalization, vaccination certificates and/or visas before boarding an aircraft or entering another country. Other restrictions may apply.

FLIGHT RECONFIRMATION, AIRPORT CHECK-IN, BAGGAGE AND AIRLINE OVERBOOKING

· Flight times change frequently and without notice. Reconfirm your first flight, return or continuing flights directly with the airlines. Domestic flights should be reconfirmed twenty-four (24) hours in advance and international flights should be reconfirmed seventy-two (72) hours in advance. Times shown on the itinerary are from the current schedules and subject to change without notice.

· Allow a minimum check-in time of two (2) hours for domestic flights and three (3) hours for international flights.

· Airline flights may be overbooked and there is a chance that a seat assignment will not be available on a flight for which a person has a confirmed reservation. If the flight is overbooked, no one will be denied a seat until airline personnel first ask for volunteers willing to give up their reservation in exchange for a payment of the airline's choosing. If there are not enough volunteers, the airline will deny boarding to other persons in accordance with their particular boarding priority. With few exceptions, persons denied boarding involuntarily are entitled to compensation.

· RBC Bank will not be liable for delays or cancellations caused by strikes, labor disputes, government actions, weather or any other causes beyond RBC Bank's control.

· Industry regulations require traveler names on all checked baggage and strongly recommend names on all carry-on baggage.

· Each airline has their own rules, fees, weight and size limitations for checked and carry-on luggage. Contact the airline for their regulations prior to your scheduled flight.

· RBC Bank is not responsible for lost, stolen, damaged or destroyed baggage or contents of baggage.

CAR RENTAL - GENERAL RULES & CONDITIONS

· All car rental redemptions are subject to the terms and conditions below.

· The renter must have a valid driver's license. Minimum rental age is twenty-five (25), however age differentials and certain restrictions may apply per rental company.

· The point values cover the base rental rate only. All taxes, fees, surcharges, extra days, extra hours, upgrades to higher car classes, optional services or equipment (if applicable), are the responsibility of the renter and are payable at the rental counter.

· Any taxes and fees levied on extra days, extra hours, upgrades to higher car classes, and optional services (if applicable), are the responsibility of the renter.

· A valid credit card in the driver's name must be presented at the rental counter for additional charges.

· No refund or credit will be given for unused portions of the rental.

· Rentals are subject to standard rental and rate conditions, as well as car availability at the time and place of rental.

· Cars must be returned to the original renting location.

· Rentals are not combinable with each other, with frequency/loyalty program miles/points or with any pre-pay rate, tour or group rate, coupon or promotion.

· Rentals are non-transferable and must be used for consecutive rental days and will be deemed fully used once a rental has begun.

HOTEL - GENERAL RULES & CONDITIONS

· All hotel certificate redemptions are subject to the terms and conditions below, and other conditions specified herein.

· Clients must have the required number of points needed to order the desired reward prior to award request.

· Lost, stolen or otherwise destroyed hotel certificate rewards cannot be replaced.

· RBC Bank and the contracted travel agency act solely as the sales agent for travel suppliers and neither is liable for actions or inactions of such suppliers.

· Once redeemed, points for voluntarily cancelled hotel reservations may not be reinstated to your account.

· Hotel certificates represent cash but are not redeemable for cash. Certificates are void if altered, photocopied or reproduced, sold for cash or other consideration.

· Hotel certificates are not combinable with upgrade certificates, other promotional certificates, group travel, tour packages, conventions or special rate programs.

· All reservations are subject to availability. Specific rules may change with or without notice. Bed types can be requested but cannot be guaranteed.

· RBC Bank may, at its discretion, change the Program or redemption rules at any time, with or without notice on a retroactive and/or prospective basis. Any rewards may be withdrawn or subject to increased points or other cash surcharges or other restrictions.

· Participating properties are subject to change.

CRUISE AND TOUR SUPPLIER TERMS AND CONDITION

· Cruise only packages do not include ground transfers. Not all air/sea packages include ground transfers.

· Cruise and tour cancellations received at any time may be subject to a program fee in addition to applicable Supplier fees.

· Travel Services is not liable for any flight or other transportation delays that result in a missed cruise or tour departure. If air or transfers are purchased as part of a specific cruise or tour company package, the cruise or tour operator may provide assistance for missed departures.

· Travel Services has no control over air arrangements recommended by cruise or tour Suppliers including flight schedules, airlines selected, or whether your flightwill be non-stop. Travel Services can assist you with deviations from the Supplier air/cruise package, but cannot guarantee that the Supplier will honor your request. Some Suppliers will not allow air deviations under any circumstances.

· It is your responsibility to make sure that deposits and final payments are made by the Supplier due date. Until payments are confirmed by the Supplier, price, cabin/room, and availability are subject to change and cancellation.

· No shows are non-refundable and will result in a forfeiture of all payments made and USD used by you in connection with the reservation, without credit due.

· You may have the option to purchase vacation protection insurance offered through the cruise or tour Supplier. If you decline any such vacation protection insurance, you will assume all risk of recovery of your costs and Travel Services will be unable to assist you. Refunds and coverage are subject to thepolicies of the individual travel insurance provider.

RETAIL GIFT CARD REWARDS

Most gift card items will be shipped within two (2) weeks of redemption. During the November/December holiday season it may take longer than usual to receive your Avion Rewards redemptions due to seasonally high demand. Redeem early to ensure that you receive your redemptions before the holidays. Gift cards are valid at a variety of national and regional merchants as well as a limited number of Canadian retailers. Any expiration dates will be printed on the front of the gift card and cannot be extended beyond the expiration date.

Due to foreign currency exchange fluctuations, gift cards issued by Canadian retailers may be offered at a different redemption value than gift cards issued by U.S. retailers and redemption values are subject to change without notice.

Complete Terms & Conditions for individual gift cards can be found on the Program web site at rbcbankrewards.com. Gift cards are not replaceable if lost, stolen, destroyed, or expired. Gift cards may not be resold, are not redeemable for cash and are void if sold for cash or other consideration. Gift cards must be surrendered at redemption. Gift cards are considered void if altered, photocopied, or reproduced. Retailers have the right to restrict usage, and participation by retailer is subject to change.

CASH-BACK CREDIT REWARDS

Cash-back Credit Rewards are normally applied to your Account within seventy-two (72) hours. The Cash-back Credit Reward is based on the number of Points available to redeem in your Avion Rewards Account and will follow the posted Avion Rewards Redemption Chart available on the My Way Cash Back Rewards page at rbcbankrewards.com. Cash-back credits are redeemed at a face value of 1% for customers with an RBC Platinum Rewards card or an RBC Signature Black card product and a face value of 1.25% for customers with an RBC Signature Black Plus card product. All Points will be immediately deducted from your available Points Balance.

MERCHANDISE REWARDS

Most merchandise items will be shipped directly from the merchant within two to three (2-3) weeks of redemption. You will receive a letter confirming your redemption. Merchandise can only be shipped to a U.S. address.

Rewards for merchandise and services are subject to availability, and some rewards have limited availability. RBC Bank reserves the right to substitute a reward of equal, similar or lesser value in the event RBC Bank determines that the chosen reward is unavailable. If a substitute is not available, Client Service will contact you with this information. Merchandise featured in print communications or on the Program web site may not necessarily reflect exact colors or models of the actual reward due to printing variation and/or manufacturers' model or style updates, or due to the use of photos or facsimiles for general representation of merchandise. RBC Bank is not responsible for manufacturer products. Please see manufacturers' individual warranty policies for product information.

A return authorization number is required for returns of defective merchandise, and must be requested within thirty (30) days of receipt. Please contact RBC Bank Client Service and indicate the nature of the defect. We will promptly issue a prepaid return label and send out the replacement upon receipt of the defective unit. For items reported more than thirty (30) days from receipt, RBC Bank Client Service will provide client with proof of purchase. This proof of purchase may be used directly with the manufacturer to arrange for appropriate service or return. For some products, the manufacturer does not allow returns but provides exceptional warranty service. Therefore the client may receive instructions on how to obtain warranty service as opposed to a complete reward replacement. All items must be returned in the original manufacturers' packaging along with all parts, accessories, and paperwork. Modified, damaged, or abused products will not be accepted for replacement or credit. You should inspect items immediately before signing for delivery or relocating. Damages and shortages must be reported within forty eight hours (48) hours of receipt. If appropriate, the shipper will arrange for pick-up of the item and a replacement will be sent out upon receipt of the damaged product. Damaged merchandise should not be moved to a different location for pick up. Items returned as undeliverable will be credited to the client.

RESPONSIBILITY

Neither RBC Bank, Kobie Marketing, Inc., other program partners, nor any of their respective officers, directors, employees, agents, successors or affiliates, assumes any responsibility or liability for, or makes any warranty regarding, any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, points account balances, credits received and redeemed or other Program activities. Neither RBC Bank, Kobie Marketing, other program partners, nor any of their respective officers, directors, employees, agents, successors or affiliates, is responsible or liable for any problem or technical malfunction relating to or arising from any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or enrolment to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to your or any other person's computer related to or resulting from participation in or downloading any materials related to the Program. If for any reason the Internet portion of the Program is not capable of functioning as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Program, RBC Bank reserves the right, in its sole discretion, to disqualify any individual who it determines may have caused or contributed to the onset of such occurrence, and/or who tampers with the entry process, and to cancel, terminate, modify or suspend the Program.

Neither RBC Bank, Kobie Marketing, or other program partners are liable for errors or omissions by its employees, contractors or agents in the printing or other dissemination of Program communications, Program mailings, other related materials or the RBC Bank Avion Rewards web site, or any other form of communication, and/or in interpreting or carrying out the terms of the Program.

INDEMNIFICATION

By accepting points or rewards, or by accepting or using an RBC Bank credit card account, you agree to indemnify each of RBC Bank, Kobie Marketing, other program partners, and each of their respective officers, directors, employees, agents, affiliates and successors for any and all claims, damages, expenses, losses and causes of action (including attorney fees and court costs) incurred or suffered by any of the foregoing persons or entities and arising out of or relating to your breach of any provision of these Program rules, or any materials (regardless of form) that are provided by you. You agree to cooperate as fully and reasonably required in our defense and/or settlement of any such claim. RBC Bank reserves the right to assume exclusive control over the defense and settlement of any matter subject to indemnification by you.

DAMAGES

Any attempt to deliberately damage any web site or undermine the legitimate operation of the Program is a violation of criminal and civil laws. RBC Bank reserves the right to seek damages for any such attempt to the fullest extent permitted by law.

DISPUTES

If you have a dispute concerning RBC Bank Avion Rewards accrual or redemption of points and/or other Program activities, please notify RBC Bank by sending an e-mail or a letter or by placing a telephone call to the RBC Bank Client Service Center. RBC Bank will investigate the matter. If following such investigation RBC Bank determines it appropriate, RBC Bank will re-credit your points for the amount in dispute, or determine that a different adjustment or no adjustment is necessary.

PRIVACY

Each client who earns and/or redeems points and/or receives rewards consents to, and authorizes RBC Bank, any of their respective subsidiaries and affiliates, and any non-affiliated third parties with whom any of the foregoing contract in order to manage and administer the Program, to share information about the client and the card account (including the Program component) as necessary or appropriate to effect, administer, enforce, service, or fulfill the terms of the Program. In addition, if the client redeems points at the RBC Bank Avion Rewards web site, then he or she thereby consents to and authorizes each of the foregoing parties to communicate with the client through electronic mail in order to accomplish the foregoing purposes. The client consents and authorizations shall be effective while the card account is open and shall not be superseded by any future privacy statement or opt-out notifications or elections the client may make.

GOVERNING LAW

All aspects of the Program are governed by the laws of the State of Georgia (without regard to its conflicts of law principles) and by applicable federal law. This Program (or as applicable, any feature thereof) is void where prohibited by federal, state or local law.
